Terms of use and sale

These terms govern website access, trials and subscriptions to the professional Skintrace service.

1. Purpose and acceptance

These terms of use and sale govern skintrace.fr and the Skintrace SaaS service published by SKINTRACE SAS. They are intended mainly for piercing, tattoo and related professionals acting for business purposes.

Creating an account, using the service or confirming an order constitutes acceptance of the version presented at that time. A person subscribing for a studio confirms that they have authority to bind that studio.

2. Service description

Skintrace provides organization tools for appointments, client records, consent forms, procedures, products and batches, sterilization, transactions, documents, exports and follow-up. Available features depend on the active plan and may require studio configuration.

Skintrace helps structure information. It does not replace the studio’s professional, health, accounting or regulatory duties, or legal, medical or tax advice. The studio remains responsible for its practices, protocols and decisions based on recorded information.

3. Accounts and access

The customer supplies accurate information, keeps contact details current and limits access to authorized people. Each operator must use a personal account where the service supports one. Sharing credentials, bypassing access controls and attempting to enter another studio workspace are prohibited.

The customer must protect authentication methods and promptly report suspicious access. The customer remains responsible for operator administration and removal of access that is no longer needed.

4. Trial, plans and orders

Where a free trial is offered, its duration and included features are shown at signup. On the effective date of these terms, signup starts with a 30-day Studio trial with no card required. After the trial, the customer chooses a paid plan or continues on the available Starter plan.

The content, limits, price, billing period and applicable taxes for each plan are those displayed before order confirmation. The customer checks this information and corrects errors before subscribing.

5. Payment, renewal and cancellation

Payments are processed by Stripe using the methods shown during subscription. The customer authorizes charges for the selected plan and billing period. An invoice is made available using the billing information supplied.

Unless stated otherwise before order, a paid subscription renews for the same billing period until cancelled. The customer can manage the subscription through the billing interface. The effective cancellation date is shown before confirmation, and amounts already due remain payable. This clause does not restrict any mandatory rights that may apply.

If payment fails, access to paid features may be limited or suspended after appropriate notices, without cancelling payment obligations already incurred.

6. Permitted use

The customer uses Skintrace in accordance with law, these terms and third-party rights. The customer must not introduce unlawful or malicious content, disrupt the service, conduct unauthorized security testing, extract data in bulk or resell access without written agreement.

The customer decides which information is necessary, informs individuals and ensures a suitable legal basis, particularly for health data, minors, photographs and consent records. Skintrace must not be used to diagnose a condition or manage a medical emergency.

7. Data and privacy

The customer retains rights in data it enters and authorizes SKINTRACE to host and process that data only to provide, secure, maintain and support the service under the contract and privacy policy.

For studio client data, the studio normally acts as controller and SKINTRACE as processor. The customer is responsible for its instructions, privacy notices, rights handling and chosen retention within service limits. Applicable data-processing terms supplement these conditions.

8. Availability, maintenance and support

SKINTRACE uses reasonable efforts to keep the service available and secure. Interruptions may be needed for maintenance, updates, a security incident, provider failure or an event outside our control. No guaranteed service level applies unless agreed separately in writing.

Support requests can be sent to skintrace.pro@gmail.com. Support helps with service use but does not validate the customer’s professional compliance.

9. Intellectual property

SKINTRACE and its licensors retain ownership of the service, code, marks, interfaces, templates and content. The customer receives a limited, non-exclusive, non-transferable and revocable right to use the service during authorized access for internal business purposes.

Feedback and suggestions may be used to improve the service without revealing confidential information or transferring customer data. No right to Skintrace marks is granted beyond what is needed to identify the service.

10. Suspension and end of service

SKINTRACE may suspend access where needed to protect the service or third parties, meet a legal duty, address non-payment or stop a serious breach. Where circumstances allow, the customer is informed and can remedy the breach.

At contract end, the customer must retrieve necessary exports within the period available for its plan. Data is then deleted or archived under the privacy policy and legal duties. Terms that by nature must survive, including payment, ownership, liability and governing law, remain effective.

11. Liability

Each party is responsible for direct damage caused by its breach within limits permitted by law. SKINTRACE is not responsible for the studio’s professional decisions, inaccurate or unlawful customer-supplied data, use contrary to documentation, or a third-party service selected or configured by the customer.

The service does not guarantee that a record, consent form, register or export alone satisfies every requirement applicable to the studio. Nothing excludes liability that cannot lawfully be excluded, including for gross negligence, intentional misconduct, physical injury or breach of a mandatory duty.

12. Changes, governing law and disputes

These terms may change to reflect legal, technical or functional developments. A new version applies to new orders when published. For a current subscription, a material change is announced before it takes effect where required by law or the nature of the change.

These terms are governed by French law. The parties first seek an amicable resolution. If that fails, disputes are heard by courts designated under statutory jurisdiction rules; no term removes mandatory judicial protection from either party.
